Don't forget a Will once it is made. |
|
Although it is extremely important to make a Will it is just as important to keep it under review in case circumstances have changed which make some of the provisions of the will out of date or irrelevant. A beneficiary may have died or an asset lost or sold which could result in a partial intestacy or a disappointed beneficiary. Sometimes a change in legislation can result in a need to revise the provisions of a will because new legislation may create disadvantages from an Inheritance Tax viewpoint, or supersede the need to make tax efficient arrangements in the will. Such legislation has now made it unnecessary to have the "Nil-Rate Band Discretionary Trusts" written into a will in order to gain two nil-rate bands for the survivor of a marriage or civil partnership. This is now allowed by legislation upon application by the executors of the estate of the survivor. So if the only reason for the Nil-Rate Band Trust being written into the will was to gain this Inheritance Tax saving it can now be taken out, which no doubt will make the will seem more straight forward and easier to understand. Advice should be sought therefore on revising such a will. |
